INITIATED BY: CITY MANAGER'S DEPARTMENT (Paul Arevalo, City Manager)(9., (Mike Jenkins, City Attorney) STATEMENT ON THE SUBJECT: The City Council will consider adopting two resolutions approving exceptions to the 180-Day Wait Period pursuant to Government Code Sections 7522.56 and 21224 to retain the services of retired Assistant City Manager Samuel Baxter and retired Administrative Services Director LuNita Bock to fill critically needed extra help positions performing limited duration special project work. RECOMMENDATIONS: 1. Adopt Resolution No. 15 - "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST HOLLYWOOD FOR EXCEPTION TO THE 180-DAY WAIT PERIOD GC SECTION 7522.56 & 21224 FOR SAMUEL BAXTER IV." 2. Adopt Resolution No. 15 - "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST HOLLYWOOD FOR EXCEPTION TO THE 180-DAY WAIT PERIOD GC SECTION 7522.56 & 21224 FOR LUNITA BOCK." BACKGROUND ANALYSIS: Samuel Baxter, Assistant City Manager retired from the City effective December 5, 2015. Sam was the City of West Hollywood's executive responsible for managing an ongoing capital project litigation case involving the City of West Hollywood. Sam plays a critical role for the City in managing the high profile and complex case in direct coordination with the City's outside legal counsel. Sam is uniquely suited as he has the institutional knowledge, experience and has been extensively involved with the case. Sam's continued involvement is critical to ensure continuity with the overall preparation of the case for the City. This is a critically needed extra help position and the City cannot wait six months due to Sam's knowledge of the history and knowledge of specific details related to the case and the ongoing work that needs to be performed by the City for the preparation of pending litigation. LuNita Bock, Director of Administrative Services retired from the City effective December 3, 2015. LuNita was the City of West Hollywood's director responsible for managing ongoing employment litigation cases against the City of West Hollywood. LuNita plays a critical role for the City in managing the high profile and complex employment cases in direct coordination with the City's outside legal AGENDA ITEM S.Q.
